This Privacy Policy describes the policies and procedures of Applyense LLC., its subsidiaries and affiliated companies (“Applyense”, “we”, “our” or “us”) on the collection, use and disclosure of your information on (“Website”), and the software, services, features, content, applications, and products we offer (collectively, the “Application” or “App”).  When you (“User”) use the Services, you are consenting to the collection, transfer, manipulation, analysis, storage, disclosure and other uses of your information as described in this Privacy Policy.

The Privacy Policy may be changed at any time upon the sole discretion of Applyense and without prior notice to the User. The revised Privacy Policy will be effective immediately when posted on the Website. It is the responsibility of each User to review the Privacy Policy periodically to learn of any revisions to this Privacy Policy. Your continued use of the App or the Website after the effectiveness of such revisions will constitute your acknowledgment and acceptance of the terms of the revised Privacy Policy.

The Privacy Policy set forth is for Applyense’s App and Website only.  If User visits any other site referred on the Website, the same shall be governed by the privacy policy of such sites.

Collection of Information

We value your anonymity.  We DO NOT collect personally identifiable information of the User such as names, email address, or payment data when downloading the App (“Personally Identifiable Information”).  Users who download and use our App enter into the App information such as zip code, age and income (“Non-Personally Identifiable Information”), but we do not receive Personally Identifiably Information from our application store platform partners.  We only collect Personally Identifiable Information voluntarily provided by the User while using the App or Website.  We use User information to provide our services to you, enhance the operation of the app, analyze app use, improve our services offerings, and to tailor your experience with services from relevant third parties.

Types of Information Collected

This Privacy Policy covers the treatment of personally identifiable information (“Personal Data”) gathered when you use or access the Application or the Website. Among the types of Personal Data that this Application or Website collect, by itself or through third parties, are Cookies, user inputs and Email.

  • The Personal Data may be freely provided by the User. We value your anonymity and do not ask or require Personal Data.
  • Private data such as income provided by the User for the App is Non-Personally Identifiable.
  • Any use of Cookies – or of other tracking tools – by this Application or Website or by the owners of third party services used by this Application or Website, unless stated otherwise, serves to identify Users and remember their preferences, for the sole purpose of providing the service required by the User.

Use / Release of Personally Identifiable Information

We will not share your Personally Identifiable Information with other parties except as provided below:

  • We may share your email address with relevant third party service providers if (i) you provide your email voluntarily and (ii) search for said service providers (e.g., local law firms).
  • We may also use Personally Identifiable Information to troubleshoot, resolve disputes, accomplish administrative tasks, contact you, enforce our agreements with you, including our Terms of Service and this Privacy Policy.
  • Merger/Acquisition: As with any other business, we could merge with, or be acquired by another company. If this occurs, the successor company would acquire the information we maintain, including Personally Identifiable Information. However, Personally Identifiable Information would remain subject to this Privacy Policy.
  • We may share your information for our Protection and the Protection of Others. We may also disclose Personally Identifiable Information when we believe release is appropriate to comply with the law or a court order; enforce or apply this Privacy Policy, our Terms of Service or other agreements; or protect the rights, property or safety of the App or Website, its Users or others.
  • As required by a legal process under the jurisdiction of a competent legal authority

Use / Release of Non-Personally Identifiable Information

We may disclose or share Non-Personally Identifiable Information with business partners, affiliates, advertisers or other parties. For example, we may share aggregated demographic information (which does not include any Personally Identifiable Information) with “Third Party Advertisers” or “Third Party Advertising Companies” and other parties as provided below:

  • We may use Third Party Service Providers to track and analyze Non-Personally Identifiable usage and volume statistical information from our Users to administer our Website and constantly improve its quality and our product offerings. We may also publish this information for promotional purposes or as a representative audience for Third Party Advertisers. Please note that this is not Personally Identifiable Information, only general summaries of the activities of our Users. Such data is collected on our behalf, and is owned and used by us.
  • We may use our internally developed tools to analyze aggregate User information, such as intensity and frequency of exercises performed, progress statistics and other data pertaining to an exercise or a workout, wellness or fitness session or program. Such aggregated, non-personally identifying information may have various future uses and applications for use by us or other parties.

Security of Information and Release

We take information security seriously.  Applyense cannot, however, ensure or warrant the security of any information User transmit to Applyense Application and User do so at his/her own risk. Using unsecured Wi-Fi or other unprotected networks to submit information is never recommended. Once Applyense receives User’s transmission of information, Applyense makes commercially reasonable efforts to ensure the security of Applyense’s systems.

 You hereby waive, release, and forever discharge Applyense, its current and former affiliates, subsidiaries, related companies, predecessors, governors, directors, officers, members, attorneys, or agents, from any and all losses, damages, costs, actions, suits, complaints, or injuries to you, whether known or unknown, liquidated or unliquidated, absolute or contingent, that are directly or indirectly related to, caused by, or arise out of a data security breach.  In addition, you agree to at all times hold harmless, indemnify, defend, and forever release and discharge Applyense from and against any and all claims, liabilities, actions, or causes of action threatened or asserted against Applyense or that could be asserted against Applyense arising out of or resulting from a data security breach, or any commenced or threatened action by a third party against Applyense arising out of or relating to a data security breach.

Data Tracking

Cookies: To facilitate and customize User experience with the Website, Applyense reserves the right to store cookies on User’s electronic device. A cookie is a small text file that is stored on a User’s computer for record-keeping purposes which contains information about that User. We use cookies to save your time while using the Website, remind us who you are, and track and target User interests in order to provide a customized experience. Cookies also allow us to collect Non-Personally Identifiable Information from you, such as which pages you visited and what links you clicked on. Use of this information helps us to create a more user-friendly experience for all visitors. In addition, we may use Third Party Advertising Companies to display advertisements on our Website. As part of their service, they may place separate cookies on your computer. We have no access to or control over these cookies. This Privacy Policy covers the use of cookies by our Website only and does not cover the use of cookies by any Third Party Advertiser. Most browsers automatically accept cookies, but you may be able to modify your browser settings to decline cookies. Please note that if you decline or delete these cookies, some parts of the Website may not work properly.
